Terms of Service

These Terms of Service (“Terms”) govern access to and use of the HMG County Market Reports website and digital products (the “Service”) operated by ExtraSphere Media LLC (“Company,” “we,” “us”). By using the Service or purchasing a report, you agree to these Terms.

1. The Service

HMG provides automated, county-level market information PDFs derived primarily from public U.S. federal datasets (including CMS and/or HRSA and Census-related sources as described on the site). The Service is a business information product, not consulting, not medical care, and not a government service.

2. Operator

The Service is operated by ExtraSphere Media LLC. HMG is a product brand of the Company.

3. Eligibility

You must be able to form a binding contract and use the Service only for lawful business or professional purposes. You represent that you are not purchasing on behalf of a minor.

4. Accounts

Consumer checkout does not require a customer account. You must provide a valid email address for delivery of digital goods. You are responsible for keeping download links confidential.

5. Products and pricing

One-time digital PDF reports are offered by product type and county. Current list prices are approximately $99–$249 per report (HPSA $249; Home Health and Hospice $99; Skilled Nursing $129), subject to change and to the price shown at checkout. Taxes may apply. One-time digital PDF download per county report. No subscription required.

Some counties may be shown as informational only when sellable thresholds are not met; checkout will be unavailable for those markets.

6. Payments

Payments are processed by Stripe. By paying, you authorize charges for the selected report. We may refuse or cancel orders that appear fraudulent or violate these Terms.

7. License to digital content

Upon successful payment, we grant you a limited, non-exclusive, non-transferable license to download and use the purchased PDF for your internal business purposes. You may not resell, republish, scrape, bulk redistribute, or present the report as your own original research or as an official CMS/HRSA product without our prior written consent.

8. Delivery

Digital reports are delivered via secure download link (and email when email delivery is configured). Links may expire or be usage-limited for security. Contact support if delivery fails after payment.

9. Acceptable use

• No unlawful use, reverse engineering of protected systems, or abuse of the Service
• No attempts to bypass paywalls, download limits, or security controls
• No use of the Service to provide medical advice or patient referrals
• No misrepresentation of affiliation with CMS, HRSA, HHS, HUD, or Census

10. Data and accuracy

Reports are based on public datasets that may be incomplete, delayed, or revised by the publisher. Metrics are calculated deterministically from available fields; missing values are not treated as zeros. Facility location, service ZIP mapping, and designation geography have inherent limits described in methodology pages. We do not guarantee fitness for a particular investment, licensing, or clinical decision.

11. Disclaimer of warranties

THE SERVICE AND ALL REPORTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXTRASPHERE MEDIA LLC AND ITS OFFICERS, MEMBERS, AND CONTRACTORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE OR A PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

13. Indemnity

You agree to indemnify and hold harmless ExtraSphere Media LLC from claims arising out of your misuse of the Service, violation of these Terms, or violation of third-party rights.

14. Refunds

Digital goods refunds are described in our Refund Policy.

15. Intellectual property

Site design, software, branding, report templates, and compilation of public data into HMG reports are owned by ExtraSphere Media LLC or its licensors. Public source data remains subject to the rights of the original publishers.

16. Third-party links and sources

Links to CMS, HRSA, Census, and other sites are for reference. We are not responsible for third-party content or availability.

17. Suspension

We may suspend or terminate access for violations of these Terms, security risk, or legal requirements.

18. Governing law

These terms are governed by the laws of the United States and the state in which ExtraSphere Media LLC is organized, without regard to conflict-of-law principles.

19. Changes

We may update these Terms by posting a revised version with a new effective date. Continued use after changes constitutes acceptance where permitted by law.
